Scott D. Smith - Of Counsel

A native Houstonian, Mr. Smith is a well-seasoned trial lawyer who has taken favorable verdicts for clients on both sides of the docket. He has experience in all phases of litigation in both state and federal courts, including resolving an array of business and commercial disputes as well as FINRA arbitration proceedings and securities litigation. Mr. Smith has represented large and small public and private companies, their directors, officers, employees, and affiliates on a broad spectrum of securities and employment litigation actions, including regulatory and compliance matters. He has also successfully argued appeals before the United States Court of Appeals for the Second Circuit, the New York State Appellate Division, First and Second Judicial Departments, and the First and Fourteenth Court of Appeals.

Mr. Smith has represented clients from all walks of life, both as plaintiffs and defendants, in cases involving breach of contract, business torts, fraud, tortious interference with contract, theft of trade secrets, business disparagement, unfair competition, shareholder disputes, personal injury, DTPA claims, employment, and real estate matters. In addition to complex commercial and general civil litigation, Mr. Smith’s practice is also concentrated on matters related to legal ethics and professional responsibility, including malpractice and negligence actions, conflicts of interest, as well as addressing a broad range of risk management issues that law firms face.

Mr. Smith joined Henneman Rau LLP in January 2017. Previously, Mr. Smith served as Of Counsel for the Law Office of Larry P. Smith in Houston, Texas and was the Litigation Manager for D. Miller & Associates, PLLC. Prior to his return to Houston, Mr. Smith was a Partner with McCormick & O’Brien, LLP, a boutique commercial and securities litigation firm in New York City. Mr. Smith also served as Counsel to the Disciplinary Committee for the First Judicial Department, as well as a Court Attorney with the Appellate Division, First Judicial Department, both in Manhattan. Prior to his government service, Mr. Smith was associated with the law firms of Robinson Brog Leinwand Greene Genovese & Gluck P.C. and Bernstein Litowitz Berger & Grossmann LLP, and was an Associate with Bernstein Liebhard LLP, where he represented aggrieved investors in class action lawsuits.
